Welcome to kyleperofineart.com (the "Site"). These Terms of Service ("Terms") govern your use of the Site. By accessing or using the Site, you agree to be bound by these Terms and all applicable laws in the State of Oregon.
1. Site Status & "Shop Opening Soon"
The Site is currently in a pre-launch phase for browsing and informational purposes only. While products and pricing (such as Limited and Open Edition prints) may be displayed, the shop is not yet open for transactions. No binding contract for sale is formed by browsing the Site until the checkout functionality is officially enabled.
2. Intellectual Property
All content on this Site—including but not limited to the Point Cloud Photography, text, graphics, logos, and "The Feeling of Having Been There" branding—is the exclusive property of Kyle Pero.
Copyright: You may not reproduce, distribute, or modify any artwork or content without express written permission.
Usage: Digital assets are for personal viewing only and may not be used for commercial purposes or AI training models.
3. Products & Editions
When the shop opens for business, the following general terms will apply to art sales:
Paper Quality: Every piece is meticulously produced on 310 gsm German Etching Paper using archival inks to guarantee exceptional depth, clarity, and museum-grade longevity.
Limited Editions: Strictly limited to a run of 25 prints. Once sold out, no further prints of that specific size and edition will be produced.
Open Editions: Available in versatile sizes and printed to order.
Display: Prices reflect the "print only" unless otherwise stated. Custom framing is a separate service.
4. Limitation of Liability
The Site and its content are provided on an "as-is" basis. Kyle Pero Fine Art makes no warranties, expressed or implied, regarding the continuous availability of the Site or the absolute accuracy of the digital representations of physical prints.
5. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Portland, Oregon.
